Terms and Description of Services
We provide an array of services including Inventory management, Invoicing, Reporting tool, Estimate/Order Form creator and so on to serve as a complete business management software ("Service" or "Services"). The User may use the Services for his/her personal and business use or for internal business purpose in the organization that he/she represent. The User may download the application from the Official website/ Google Play Store using the Internet. Once downloaded, the User no longer needs an internet connection for its usage. A User can create and add content to his/her account staying offline. But, the User is responsible for obtaining access to the Internet and the device necessary to use the Services. ( Side Note: PayTrakz tries its best to make Businesses compliant to taxation and other laws as much as possible. But, it is solely the User’s responsibility to see that he/she remains compliant with GST and other laws levied by Government. PayTrakz is not in any case responsible for the violation of the compliance caused by software) For the software subscription services purchased on PayTrakz, the validity of the license period shall commence on or before 60 days since the date of purchase. PayTrakz reserves all rights to increase or reduce this grace period.
1.SERVICES
- 1.The Platform allows small businesses such as vendors, contractors, merchants, and suppliers (hereafter, “Merchants”) to record their daily transactions, such as the expenses, tasks to be completed on the project site, project photographs, with their customer projects (“Customers”). In addition, the Platform uses technology to facilitate transactions between Merchants and Customers and uses data-backed insights to meet Users’ untapped needs. Further, Onsite facilitates the provision of financial products and services to Users (all the services described here, including the provision of the Platform and its features, collectively constitute the “Services”).
- 2.Merchants and Customers are collectively referred to as “Users”.
- For the avoidance of doubt, a Merchant may be considered a Customer in certain transactions (and vice versa). For example, in a situation where the Merchant is getting his project managed from a supplier that are recorded on the Platform, the Merchant would be considered a Customer and the supplier a Merchant.
2.PROFILE CREATION
- 1.To avail the Services, a Merchant would be required to create a merchant profile on the Platform (“Profile”). In addition to setting up a username and password to create the Profile, the Merchant will be required to furnish certain details, including but not limited to phone numbers and details of their businesses. The Merchant warrants that all information furnished in connection with its Profile is and shall remain accurate and true in all respects, and agrees that it shall promptly update its details on the Platform in the event of any change or modification.
- 2.The Merchant is solely responsible for maintaining the security and confidentiality of its username and password, and agrees to immediately notify Onsite of any disclosure or unauthorized use of its Profile or any other breach of security with respect to its Profile.
- 3.The Merchant expressly agrees to be liable and accountable for all activities that take place through its Profile. Onsite shall in no manner be held liable for any unauthorized access to a Merchant’s Profile.
- 4.The Merchant agrees to receive communications from Onsite regarding: (i) information relating to transactions recorded on the Platform; (ii) requests for payment; (iii) information about Onsite and the Services; (iv) promotional offers and services from Onsite and its third-party partners, and (v) any other matter in relation to the Services.
3.KYC
- 1.Onsite may be required to undertake certain “know your customer” processes in relation to Users who intend to avail certain features of the Services. In this regard, Onsite from time to time shall require Users to upload information and documents that may be necessary to ascertain their eligibility to use certain features of the Services (“KYC Documents”).
- 2.The User authorizes Onsite, and any third-party service provider it may engage with, to process KYC Documents and ascertain its eligibility. Any processing undertaken by Onsite shall be in accordance with its Privacy Policy. The User agrees that it may be subject to additional terms of service in the event a third party processes information under this Clause. Further, in the event any additional information, data, or documentation is required to determine eligibility (collectively, “Additional Information”), the User hereby agrees to share such Additional Information promptly upon request, and further, authorizes Onsite to process such Additional Information.
- 3.The User agrees and warrants to provide true, complete, and up-to-date KYC Documents and Additional Information. The User further acknowledges that (i) any false or misleading information provided in this regard shall constitute a material breach of these Terms, and (ii) its access to certain features of the Services may be limited or denied if it fails to share KYC Documents and Additional Information.
4.TRANSACTION INFORMATION
- 1.Merchants may upload information relating to transactions with Customers, including the sale of goods or services, costs, amounts paid and payable, and details of goods and services, on the Platform (such information is referred to as “Transaction Information”). Transaction Information may be exchanged between Merchants and Customer through telephonic calls, text message, WhatsApp, email, or other electronic mediums that would depend on the contact details of Merchants and Customers provided on the Platform.
- 2.At the time of creating or uploading the first Transaction Information with respect to a Customer, the Merchant shall inform such Customer of its use of the Platform to record such Transaction Information and Transaction Information related to future transactions and seek such Customer’s express consent in this regard and to:
- 3.The creation of a profile of the Customer on the Platform, which will require sharing such Customer’s phone number and contact details with Onsite; and receive communications from Onsite regarding: (A) information relating to transactions recorded on the Platform; (B) requests for payment; (C) information about Onsite and the Services; (D) promotional offers and services from Onsite and its third-party partners, and (E) any other matter in relation to the Services.
- 4.Should the Customer fail to provide consent, or withdraw consent, the Merchant shall immediately cease to use the Services in relation to that Customer.
5. THIRD PARTY SERVICES
- 1. The Services may include services, content, documents, and information owned by, licensed to, or otherwise made available by a third party (“Third Party Services”) or contain links to Third Party Services. Users understand that Third Party Services are the responsibility of the third party that created or provided it and acknowledge that use of such Third Party Services is solely at their own risk.
- 2. Onsite makes no representations and excludes all warranties and liabilities arising out of or pertaining to such Third Party Services, including their accuracy or completeness. Further, all intellectual property rights in and to Third Party Services are the property of the respective third parties.
6. YOUR RESPONSIBILITIES
- 1. The User represents and warrants that all information that is provided through or in relaion to the Services is complete, true, and correct on the date of agreeing to these Terms and shall coninue to be complete, true, and correct while the User avails the Services. Should any information that the User provides change during the existence of these Terms, the User undertakes to immediately bring such change to Onsite’s noice. Onsite does not accept any responsibility or liability for any loss or damage the User may suffer or incur if any informaion, documentaion, material, or data provided to avail the Services is incorrect, incomplete, inaccurate, or misleading, or if the User fails to disclose any material fact.
- 2. The User shall be solely responsible for ensuring compliance with applicable laws, and shall be solely liable for any liability that may arise due to a breach of its obligations in this regard.
- 3. The User shall extend all cooperaion to Onsite in its defence of any proceedings that may be initiated against it due to a breach of the User’s obligations or covenants under these Terms.
- 4. While Onsite uses commercially reasonable efforts to provide Users with a daily backup of their Transaction Informaion, Users should regularly and independently save, backup, and archive such Transaction Information.
- 5. The User shall not use the Services in any manner except as expressly permiƩed in these Terms. Without limiting the generality of the preceding sentence, the User may not:
- 6. infringe any proprietary rights, including but not limited to copyrights, patents, trademarks, or trade secrets, of any party;
- 7. except as may be provided hereunder, copy, display, distribute, modify, publish, reproduce, store, transmit, post, translate, create any derivative works from, or license the Services;
- 8. use the Services to transmit any data or send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programmes or similar computer code designed to adversely affect the operation of any computer soŌware or hardware;
- 9. use any robot, spider, other automated device, or manual process to monitor or copy the Plaƞorm or Services or any portion thereof;
- 10. engage in the systematic retrieval of content from the Plaƞorm or Services to create or compile, directly or indirectly, a collection, compilation, database or directory;
- 11. use the Services in (A) any unlawful manner, (B) for fraudulent or malicious activities, or (C) in any manner inconsistent with these Terms; or
- 12. violate applicable laws in any manner.
7. OUR INTELLECTUAL PROPERTY
- 1. All rights, title, and interest in and to the Platform and Services, including all intellectual property rights arising out of the Platform and Services, are owned by or otherwise licensed to Onsite. Subject to compliance with these Terms, Onsite grants the User a non-exclusive, non-transferable, non-sub licensable, royalty-free, revocable, and limited license to use the Platform and Services in accordance with these Terms and its written instructions issued from time to time.
- 2. Onsite may request Users to submit suggestions and other feedback, including bug reports, relating to the Platform or Services from time to time (“Feedback”). Onsite may freely use, copy, disclose, publish, display, distribute, and exploit the Feedback without any payment of royalty, acknowledgment, prior consent, or any other form of restriction arising out of the User’s intellectual property rights.
- 3. Except as stated in these Terms, nothing in these Terms should be construed as conferring any right in or license to Onsite’s or any third party’s intellectual rights.
8. TERM AND TERMINATION
- 1. These Terms shall remain in effect unless terminated in accordance with the terms hereunder.
- 2. Onsite may terminate a User’s access to or use of the Services, or any portion thereof, immediately and at any point, at its sole discretion if the User violates or breaches any of its obligations, responsibilities, or covenants under these Terms.
- 3. Upon termination under Clause 8(b):
- 4. the Services will “time-out”;
- 5. the User shall not be eligible to avail any features of the Services; and
- 6. these Terms shall terminate, except for those clauses that expressly or are intended to survive termination or expiry.
- 7. Notwithstanding anything to the contrary contained in the Terms, upon termination of a User’s access to or use of the Services, all amounts or outstanding monies due by you in relation to your use of or access to the Services shall become immediately payable.
9. DISCLAIMERS AND WARRANTIES
- 1. The use of the Services is at your sole risk.
- 2. You acknowledge and agree that Onsite is not engaged in the provision, grant, or disbursement of any financial product. Onsite is not and will not be responsible for any claim or for any damages suffered that are related, directly or indirectly, to or arise out of the use of financial products.
- 3. To the extent permiƩed by applicable law, the Services are provided on an “as is” and “as available” basis. Onsite does not warrant that operation of the Services will be uninterrupted or error free or that the functions contained in the Services will meet your requirements.
- 4. To the fullest extent permissible under applicable law, Onsite expressly disclaims all warranties of any kind, express or implied, arising out of the Services, including warranties of merchantability, fitness for a particular purpose, satisfactory quality, accuracy, title and non- infringement, compatibility, applicability, usability, appropriateness, and any warranty that may arise out of course of performance, course of dealing, or usage of trade.
- 5. You hereby accept full responsibility for any consequences that may arise from your use of the Services, and expressly agree and acknowledge that Onsite shall have absolutely no liability with respect to the same.
- 6. To the fullest extent permissible by law, Onsite, its affiliates, and its related parties each disclaim all liability to you for any loss or damage arising out of or due to:
- 1. your use of, inability to use, or availability or unavailability of the Services, including any Third Party Services;
- 2. the occurrence or existence of any defect, interruption, or delays in the operation or transmission of information to, from, or through the Services, communications failure, theŌ, destruction or unauthorised access to Onsite’s records, programmes, services, server, or other infrastructure relating to the Services; or
- 3. the failure of the Services to remain operational for any period of time.
- 7. Notwithstanding anything to the contrary contained herein, neither Onsite nor any of its affiliates or related parties shall have any liability to you or any third party for any indirect, incidental, special or consequential damages or any loss of revenue or profits arising under, directly or indirectly, or relating, in any manner whatsoever, to these Terms or the Services. To the maximum extent permiƩed by law, you agree to waive, release, discharge, and hold harmless Onsite, its affiliated and subsidiary companies, its parent companies, and each of their directors, officers, employees, and agents, from any and all claims, losses, damages, liabilities, expenses and causes of action arising out of the Services.
10. INDEMNITY
You shall indemnify, defend at Onsite’s option, and hold Onsite, its parent companies, subsidiaries, affiliates, and their officers, associates successors, assigns, licensors, employees, directors, agents, and representatives, harmless from and against any claim, demand, lawsuits, judicial proceeding, losses, liabilities, damages and costs (including, without limitation, from all damages, liabilities, seƩlements, costs and aƩorneys’ fees) due to or arising out of your access to the Services, use of the Services, violation of these Terms or any infringement by any third party who may use your account with Onsite, of these Terms.
11. CONSENT TO USE DATA
- 1. You agree that Onsite may in accordance with its Privacy Policy collect and use your information and technical data and related information.
- 2. Onsite may use information and data pertaining to your use of the Services for analytics, trends’ identification, and purposes of statistics to further enhance the effectiveness and efficiency of the Plaƞorm.
- 3. Subject to applicable laws, Onsite may be directed by law enforcement agencies or the government and related bodies to disclose data in relation to Users in connection with criminal proceedings. You understand and agree that in such instances, Onsite shall have the right to share such data with relevant agencies or bodies.
12. MODIFICATION
Onsite reserves the right at any time to add, modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without cause. Onsite shall not be liable for any such addition, modification, suspension or discontinuation of the Services.JURISDICTION, GOVERNING LAWS, AND DISPUTE RESOLUTION These Terms shall be governed by and construed and enforced in accordance with the laws of India. Subject to other provisions in this Clause, courts in Bangalore shall have exclusive jurisdiction over all issues arising out of these Terms or the use of the Services. Any controversies, conflicts, disputes, or differences arising out of these Terms shall be resolved by arbitration in Bangalore in accordance with the Arbitration and Conciliation Act, 1996 for the time being in force, which is deemed to be incorporated by reference in this Clause. The tribunal shall consist of 1 (one) arbitrator appointed by Onsite. The language of the arbitration shall be English. The parties to the arbitration shall keep the arbitration confidential and not disclose to any person, other than on a need to basis or to legal advisors, unless required to do so by law. The decision of the arbitrator shall be final and binding on all the Parties hereto. Each party to the arbitration shall bear its own costs with respect to any dispute.
13. MISCELLANEOUS PROVISIONS
- 1. Modification – Onsite reserves the right at any time to modify these Terms and to add new or additional terms or conditions on use of the Services. Such modifications and additional terms and conditions will be communicated to you and, unless expressly rejected (in which these Terms shall terminate), will be effective immediately and will be incorporated into these Terms. In the event you refuse to accept such changes, these Terms will terminate.
- 2. Severability – If any provision of these Terms is determined by any court or other competent authority to be unlawful or unenforceable, the other provisions of these Terms will continue in effect. If any unlawful or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect (unless that would contradict the clear intention of the clause, in which case the entirety of the relevant provision will be deemed to be deleted).
- 3. Assignment – You shall not licence, sell, transfer or assign your rights, obligations, or covenants under these Terms in any manner without Onsite’s prior wriƩen consent. Onsite may grant or withhold this consent in its sole discretion and subject to any conditions it deems appropriate. Onsite may assign its rights to any of its affiliates, subsidiaries, or parent companies, or to any successor in interest of any business associated with the Services without any prior notice to you.

- 5. Third Party Rights – No third party shall have any rights to enforce any terms contained herein.
- 6. Translations – Onsite may provide you with translated versions of these Terms solely to assist you with understanding these Terms in greater detail. The English version of these Terms shall be controlling in all respects. In the event of any inconsistency between the English version of these Terms and any translated version, the terms of the English version shall prevail.
Business Data and Privacy
The User alone is responsible for maintaining the confidentiality of his/her username, password and other sensitive information. He/She is responsible for all activities that occur in his/her user account and he/she agrees to inform us immediately of any unauthorized use of their user account by email to reachus@Infobytestechnosys.in or by calling us on any of the numbers listed on http://Infobytestechnosys.in/#contact. We are not responsible for any loss or damage to his/her or to any third party incurred as a result of any unauthorized access and/or use of his/her user account, or otherwise. We are neither responsible for any kind of data loss as performing necessary backups on data is solely the User’s responsibility. paytrakz is not responsible for any kind of data discrepancy or any type of loss occured due to data discrepancy/software issue.
Data Ownership
The User owns the content created or stored by his/her as we respect his/her right to ownership of content created or stored by them. The Users use of the Services does grant paytrakz the license to use, reproduce, adapt, modify, publish or distribute the content created by them or stored in the user’s account for paytrakz internal purpose. paytrakz tries keeping Users data safe but holds zero responsibility in case of data leaks
Permissions
Camera: To take the picture of the bills etc to be attached with transactions.
Contacts:This app collects contact information like number of contacts on the device with a phone number and without a phone number. In addition to it, the app collects other non-personal information to understand the risk profile of the user and enable credit facility. This app doesn't upload your contacts information like names, phone numbers, emails addresses and other personal information to our servers.
Storage: This app collects metadata of files on your device like file names, types, created times, last updated times for credit profile enrichment.
Location: This app collects location details to verify your location & current address, to ensure serviceability and to identify unusual activity to prevent against any fraud, we do not collect location when app is in background.
SMS: This app collects SMS data like sender names, SMS body, received time to understand your income, spending patterns and automatically fetch your expenses, bills, credits. We do not read any personal or OTP messages.
Device and Personal info: This app collects and monitor specific information about users' Phone Number and your device including your hardware model, masked phone numbers, operating system and version, unique device identifiers like IMEI and serial number, user profile information to uniquely identify the devices and ensure that unauthorized devices are not able to act on your behalf to prevent frauds.
Accounts: This app collects and monitor list of account information like account names, account types in your device for credit profile enrichment.
Apps: This app collects details of your installed applications to understand your profile. This helps us give quicker approvals and higher credit limits. Call logs: This app uses call logs permission to validate your phone number using missed call. In addition to it, details of your aggregated call information is collected to understand your profile. This helps us give quicker approvals and higher credit limits. We do not read the phone numbers or any personal information.
Calendar: This app collects event data on your calendar for credit profile enrichment.
Permissions Usage:
Collection of contact
This is how we will use your contact permissions: (i) We allow users to sync their contacts from mobile to desktop, the contact permissions will be used to facilitate this. (ii) We will show parties that are already paytrakz users, to show you your potential buyers and suppliers.
Collection of SMS information
We will use SMS data like sender names, SMS body, received time to understand your income, spending patterns and automatically fetch your expenses, bills, credits. We do not read any personal or OTP messages. We collect and monitor SMS sent by 6-digit alphanumeric senders from your inbox to understand your income, spending patterns and automatically fetch your expenses, bills, credits. We collect your historical SMS data as well, as this process will enable you to take financial facilities like loans, credit cards from the regulated financial entities available on the platform. We do not read any personal or OTP messages.
Collection of device location, device information and personal information
We collect and monitor the information about the location of your device to provide serviceability of your loan application, to reduce the risk associated with your loan application and to provide pre-approved customised loan offers. This also helps us to verify the address, make a better credit risk decision and expedite the know your customer (KYC) process. Information the App collects, and its usage depends on how you manage your privacy controls on your device. When you install the App, we store the information we collect with unique identifiers tied to the device you are using. We collect information from the device when you download and install the App and explicitly seek permissions from You to get the required information from the device. The information we collect from your device includes the users' phone number, masked phone numbers, hardware model, build model, RAM, storage; unique device identifiers like IMEI, serial number, SSAID; SIM information that includes network operator, roaming state, MNC and MCC codes, WIFI information that includes MAC address and mobile network information to uniquely identify the devices and ensure that no unauthorized device acts on your behalf to prevent frauds.
Collection of installed applications
We collect a list of the installed applications’ metadata information which includes the application name, package name, installed time, updated time, version name and version code of each installed application on your device to assess your creditworthiness and enrich your profile with pre-approved customized loan offers.
Collection of Images
The images uploaded by users in paytrakz App are stored on our servers so they can be accessed from multiple devices. We do this to enhance your user experience and make it seamless
Storage
We require storage permission so that your KYC and other relevant documents can be securely downloaded and saved on your phone. You can then easily upload the correct KYC related documents for faster loan application details filling and disbursal process. This ensures that you are provided with a seamless experience while using the application.
Camera
We require the camera information permission to provide you with an easy/smooth experience and to enable you to click photos of your KYC documents along with other requisite documents and upload the same on the App during your loan application journey
Collection of other non-personal information
We automatically track certain information about you based upon your behaviour on our Platform. We use this information to do internal research on our users’ demographics, interests, and behaviour to better understand, protect and serve our users and improve our services. This information is compiled and analysed on an aggregated basis. We also collect your Internet Protocol (IP) address and the URL used by you to connect your computer to the internet, etc. This information may include the URL that you just came from (whether this URL is on our Website or not), which URL you next go to (whether this URL is on our Website or not), your computer browser information, and your IP address. The paytrakz Platform has a link to a registered third party SDK that collects data on our behalf and data is stored on a secured server to perform a credit risk assessment. We ensure that our third-party service provider takes extensive security measures in order to protect your personal information against loss, misuse or alteration of the data. Our third-party service provider employs separation of environments and segregation of duties and has strict role-based access control on a documented, authorized, need to-use basis. The stored data is protected and stored by application-level encryption. They enforce key management services to limit access to data. In addition to the General Conditions of paytrakz service a User agrees to be bound by the following terms and conditions: (i) The User agrees to receive promotional, transactional and commercial communications from paytrakz through calls, email, SMS or push notifications. (ii) Under certain conditions, promotional messages are transmitted to the users and thatpaytrakz shall not bear any further obligation in respect of such promotional messages.
Refund, Cancellation:
